SC supports TRAI's 200 SMS limit

The Supreme Court has ordered a stay on the TDSAT, telecom Tribunal's order which earlier had lashed out against the poorly thought out cap of 200 SMS per day per sim. TDSAT has earlier sent a circular against the current cap of SMS saying that it was a way of limiting the freedom of the people.

The decision was given by a bench of SC headed by Justice G S Singhvi following which it has passed a notice to Aditya, the grandson of Bal Thackeray. Aditya earlier urged the TDSAT to pass the order.

TRAI challenged the order of TDSAT in the apex court after which the stay was ordered by the SC. Telecom regulator can now enforce the cap until the stay on the TDSAT's order is vacated by the SC.

TDSAT earlier on July 17th said that the regulator made no prior consultation on levying the ceiling on the number of SMS per day per sim calling the move "arbitrary" and against the right to freedom of speech and expression which the Constitution conferred on every Indian.

Aditya Thackeray, the son of Uddhav Thackeray said that the restriction imposed was nothing but "non-application of mind" by TRAI. He also thrashed TRAI saying that the regulator has no explanation to fix the limits at 100/200 per day.

The earlier 100 SMS per day limit was increased to 200 SMS per day except on a few days that required shutdown/or limitation of the services to a bare minimum.
