Modi committed mistake but no FIR

An Ahmedabad Court on Monday said, Prime Minister Narendra Modi has committed mistake by hiding his marital status, being a public representative but the court also said, an FIR against Modi now cannot be filed as in such cases, complaints should be filed within one year as per CrPC section 468(2)(B).

 The court said, "an offence is committed under section 125(A)(3) of Representation of People [RP] Act by not disclosing facts" about Modi's marital status. The complaint against Modi was filed after one year and four months by AAP leader Nishant Verma and so the court has ruled out chances of filing case against PM Modi.

AAP leader Nishant sought FIR to be registered against Prime Minister Narendra Modi for "hiding" his marital status in the affidavit he had filed in the nomination papers in 2012 Gujarat elections. With the local court denying any sort of case against Modi, the AAP leader is considering to approach Supreme Court.

Narendra Modi for the first time disclosed his marital status and wife's name in the affidavit while filing nomination for the Vadodara Lok Sabha seat earlier this year. Modi used to leave the spouse column empty when contested for the Assembly elections in Gujarat.
