Supreme Court set asides the High Court Order in 2009 supporting homosexual activity and observes that it is and offense according to section 377 which is very clear about it.
Section 377 of British Coloniel era says “Carnal intercourse against the order of Nature” which was decriminalized by the Delhi High court in 2009. But the Supreme Court observed that such decriminalizing is not sustainable constitutionally.
Supreme Court also says that it is not the courts to decide on it but it is up to the Parliament to retain or repeal section 377 conviction under which a fine and a maximum 10 years imprisonment can be awarded by the court.
