Division Of High Court As Per Draft Bill

The Andhra Pradesh High Court established on November 5, 1956 under the State Reorganization Act 1956 is now proposed to rename it as "Hyderabad High Court" by the AP State Reorganization Bill 2013.

As per the draft bill made by the Center, the present High Court will be called "Hyderabad High Court".  A High Court for the rest of the Andhra Pradesh will be housed in a new building and until then the present high court will be jointly conducted in the present premises.  

The joint high court establishment and maintenance expenses have to be borne by the two states in the ratio of the population in the two regions.

The present Judges in the high court will act as common judges for both the states after the state is divided.  The Chief Justice of the new Andhra Pradesh State and Governor may take decision to appoint Andhra Pradesh Benches.  

Lawyers can practice in both the high courts.  

A new high court will be established in Andhra Pradesh as per the direction of the President where Chief Justice takes charge.  The judges appointed for the new AP high court will then have to go there.  The seniority in the Hyderabad High Court will continue in the New High court.  

The practicing lawyers in the present High Court under the AP Bar Council may request within one year to change their registration to the Telangana Bar Council.  

As per the merit of a case the Hyderabad High Court Chief Justice may transfer a pending case to the Andhra Pradesh High Court.
