Accused receive no probation even after 13 years

Two youth were arrested in their 20's for robbery and attacking the couple how lived in the house that they robbed at night thirteen years ago but the Bombay High Court had mercilessly rejected their please for a leniency in the punishment after their conviction.

Justice T V Nalawade held the accused Bhaskar Kale and Narayan Pawar without granting them a probation after the submission of their plea.

They had forced Jaishree's family to open the door in the night while concealing their faces with cloth and put the lives of the family who were completely vulnerable at danger, he said. He added that the court could not grant them the benefit of the Probation of Offenders act since they committed the act during the night concealing their identities. This also makes it necessary for the case to be considered a serious crime and no leniency can be given.

The incident happened in 23 Aug, 1999 in Osmanabad. The duo had broken into the house and had threatened the Jaishree family with knives and stole jewelry. They were convicted later in 2000 after the recovery of the ornament by a sessions court.
