Case against Doctor practicing from his residence revoked
The case filed against one doctor in New Delhi was relieved today in Delhi High Court, after Chief Justice has cleared the ambiguity. Chief Justice Suresh Kait has given the verdict by stating that running a clinic from a residence would not qualify as a commercial activity there by granting relief to the accused.
Chief Justice Suresh Kait had revoked the charges presented by a criminal case against a particular doctor for rendering services from a clinic in his home. “Running a clinic would not be a commercial activity and is instead a professional activity. Also, the clinic was closed years ago already. The differences in the two words, commercial and professional, is fundamental. Medicine, Law and Church were the three services that used to be encompassed under the definition of “profession” he said.
The doctor had challenged the attempt of case to be filed by the MCD against his practice from his residence in Rajouri Garden House.
