Government's Plea Turned Down By SC

Central Government's request to reconsider the judgment of Supreme Court made some time back in July on disqualification of convicted politicians barring them from continuing the Membership in the Parliament or in the State Assemblies was turned down today by the Supreme Court.  

The Judges of the Supreme Court also failed to see the point in the Government’s request to reconsider the verdict.  What interest it serves and what case the Government is making is something the judges could not grasp so had to question it.  

The political analysts called it a shameless attempt on the part of the Government to defend convicted politicians. 

The Supreme Court of India also questioned the logic behind the present law disqualifying a voter in jail from voting and at the same time allowing a person in jail contest for elections.  

This also has another side like to a coin.  Opposition parties objected that this law may give an opportunity to the parties in power to jail their opponents to make them disqualified.  

The present law says that if a politician is convicted but appeals to the higher court within 3 months of the conviction and if the case is pending in the higher court, the person is entitled to contest in the elections and it was cancelled by the Supreme Court with its latest verdict in July making them disqualified after conviction irrespective of whether they appeal or not.

But, the Supreme Court agreed to reconsider the disqualification of the politicians who are in jail and not convicted.
