Decide AP High Court in 6 months - HC

The officials of the joint High Court of the dual Telugu states said that, AP officials should take a proper decision about the separate High Court, within the next six months.

Right from the bifurcation of Telugu states, the separate High Court issue is in the news. Telangana officials like Kavitha, demanded that Hyderabad High Court should be owned by Telangana state itself, but not the dual states.

Regarding the separate High Court issue, Telangana MPs protested opposite Parliament. Reacting to the issue, Hyderabad High Court now released a notice that, to decide about a new High Court in Andhra Pradesh state, within next six months.

On May 1st, the court ordered that, “Hyderabad High Court will continue to be the common Court, till a separate High Court is formed in AP. It is not legal to construct two separate High Courts in Hyderabad itself, as the city belongs to Telangana. It is also to be remembered that, Hyderabad is not ruled by the central government, but the state government itself. Instead, the states can set up circuit benches.”

Referring to that judgment, the officials put a time limit to four key issues like High Court building, administration building, judges residences and other court staff quarters. The explanation on all the mentioned above four issues, should be given within six months of court’s notice.

Who should spend for separate High Court in AP?

It is state or central?, which government should spend money on the construction of High Court in the state? This is one such question rotating in the political circles. “According to section 94 (1), Andhra Pradesh Reorganization act, central government should provide funds for High Court construction,” said AP government’s advocate general, P Venugopal.

Within three months of release of the court’s notice, the central government is required to provide funds for AP government and the AP government is restricted to use those entire funds, solely for High Court construction only.
